When bureaucratic actions result in a murder, it is still a murder.
TO THE EASTERN DISTRICT OF MICHIGAN:
You thought you had us trapped.
You thought you could price a dying, brain-injured veteran out of justice.
You failed.
The Cowardice – Rockenhaus v. Agapiou (2:25-cv-12716)
Let the record show that every single federal judge in Detroit ran away from this case.
- Judge Laurie Michelson? Recused.
- Judge Linda Parker? Recused.
- Judge Nancy Edmunds? Recused.
- Chief Judge Stephen Murphy? Recused.
You were all too terrified or too conflicted to handle the truth about what your U.S. Marshals did to my husband.
So you had to import “cleaners” from the Western District of Michigan (Grand Rapids) to do your dirty work.
The Trap
Enter Magistrate Judge Sally J. Berens (Western District, Grand Rapids, Michigan).
Her job was to bury this case quickly so the Detroit judges wouldn’t have to answer for it.
On December 8, she recommended DISMISSING the lawsuit (Rockenhaus v. Agapiou).
Her excuse? Conrad failed to file a poverty form.
The Reality
Magistrate Judge Sally J. Berens knew perfectly well that prison officials at FCI Milan were illegally blocking the notary he needed to sign that form.
It was a procedural setup designed to silence a victim of torture.
The Deleted Evidence
On December 15, I filed a motion containing an affidavit from a notary proving the prison blocked her from entering.
On December 16, Judge Berens STRUCK that filing.
She literally deleted the proof of government obstruction from the record so she could pretend my husband was just “lazy” for not filing his forms.
Click here to read the document she tried to hide (preserved on Court Listener RECAP).
The Checkmate
On December 18, the exact same day the Eastern District was celebrating the confirmation of new U.S. Attorney Jerome Gorgon, we didn’t file another form.
WE PAID THE BILL.
Thanks to an anonymous supporter who refused to let the truth be buried by a filing fee, the full $405.00 was paid in cash to the Clerk of the Court.
The Result
- Judge Berens’ dismissal recommendation is MOOT.
- The “poverty trap” is DESTROYED.
- On December 19, the Court was FORCED to issue summonses for the very people you tried to protect.
To Jeffry Konal, Stylianos Agapiou, Dion Thomas, and John Doe:
The Eastern District judges ran away.
The Western District judges failed to stop us.
The filing fee is paid.
Expect a knock at the door with service papers.
